POPIA notice — how Makeba Markets collects, uses, discloses and protects personal information under the Protection of Personal Information Act, and, where applicable, the UK/EU GDPR and the Australian Privacy Act.
This Privacy Policy explains how Makeba Markets (Pty) Ltd (FSP 53160) ("the Company", "we", "us") collects, uses, discloses, and protects personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and, where applicable to Clients outside South Africa, other relevant data protection laws such as the UK/EU General Data Protection Regulation and the Australian Privacy Act 1988.
This Policy applies to personal information collected via our website, client portal, Trading Platform, customer support channels, and in the course of the account opening and ongoing client relationship.
Makeba Markets (Pty) Ltd is the responsible party (data controller) in respect of personal information processed for the purposes described in this Policy.

We process personal information to: open and administer trading Accounts; verify identity and comply with FICA, AML/CTF, and sanctions obligations; provide and improve our services; process deposits and withdrawals; communicate with Clients; manage complaints; meet regulatory reporting obligations to the FSCA and other competent authorities; and, where consented to, provide marketing communications. Marketing is only sent where you have opted in, and you can withdraw that consent at any time.
We process personal information on the basis that it is necessary for the performance of the Client Agreement, necessary to comply with a legal obligation (including FICA and FAIS requirements), necessary for our legitimate interests (such as fraud prevention and service improvement), or on the basis of consent where required.
We may share personal information with: banking, payment, and electronic money institution partners for the purpose of processing deposits and withdrawals; liquidity providers, to the extent necessary to execute trades; regulators, including the FSCA and the Financial Intelligence Centre; auditors and professional advisors; and service providers who support our operations (for example platform hosting, identity verification, and customer support tools), each bound by appropriate confidentiality and data protection obligations.
We do not sell personal information to third parties.
Given that the Company services clients in South Africa, the European Union, the United Kingdom, and Australia, personal information may be transferred to and processed in jurisdictions other than the Client's country of residence, including South Africa. Where such transfers occur, we take reasonable steps to ensure the receiving party is subject to a comparable level of data protection, whether through contractual safeguards, an adequacy framework, or other lawful transfer mechanism.
Personal information is retained for as long as necessary to fulfil the purposes described in this Policy, including the record-keeping periods mandated under FICA and FAIS (generally a minimum of five years following termination of the relationship), after which it is securely deleted or anonymised, unless a longer period is required by law.
We implement appropriate technical and organisational measures, including access controls, encryption of sensitive data in transit and at rest, and staff confidentiality obligations, to protect personal information against loss, unauthorised access, alteration, or disclosure.
Subject to Applicable Regulations, you have the right to: request access to the personal information we hold about you; request correction of inaccurate or incomplete information; request deletion of personal information no longer required for a lawful purpose; object to processing carried out on the basis of legitimate interest; withdraw consent where processing is based on consent; and lodge a complaint with the Information Regulator (South Africa) or, where applicable, your local data protection authority.
